CHAPTER 360

An act to add Section 10372 to the Public Contract Code, and to add Section 25724.4 to the Public Resources Code, relating to air pollution.

SB 1010, Skinner. Air pollution: state vehicle fleet.
Existing law sets forth requirements for the acquisition of goods and services by state agencies and sets forth the various responsibilities of the Department of General Services and other state agencies in overseeing and implementing state contracting procedures and policies.
This bill would require the department, on and after January 1, 2024, to develop criteria to evaluate bidders, at least in part, based on the number of zero-emission vehicles or plug-in hybrid electric vehicles in their rental car fleet when seeking to award a contract for commercial rental car services.
This bill would, among other things, state that the installation of electric vehicle supply equipment or supporting electrical and hydrogen fueling infrastructure by state entities to support specified state fleet operations do not constitute gifts of public funds.

The people of the State of California do enact as follows:


SECTION 1.

 The Legislature finds and declares all of the following:
(a) Governor Brown in Executive Order No. B-16-2012 stated a goal of having 1,500,000 zero-emission vehicles on the road by 2025.
(b) Governor Newsom in Executive Order No. N-79-20 set a state goal of banning the sale of new gasoline- and diesel-powered cars by 2035, and the sale of new gasoline- and diesel-powered medium- and heavy-duty vehicles by 2045, where feasible.
(c) Fleets represent a large number of motor vehicles owned and operated in the state.
(d) Owners of fleet vehicles are more likely to have access to centralized vehicle charging and fueling infrastructure.
(e) Demand from fleet owners can help expand the vehicle charging and fueling infrastructure available to the general public.
(f) A number of programs have been established at the State Air Resources Board to address transportation sector emissions, including programs designed to encourage the adoption and deployment of zero-emission vehicles.
(g) To achieve California’s climate change goals, the state board must maximize efforts to increase fleet deployment of zero-emission vehicles statewide.

SEC. 2.

 Section 10372 is added to the Public Contract Code, to read:

10372.
 On and after January 1, 2024, when seeking to award a contract for commercial rental car services, the department shall develop criteria to evaluate bidders, at least in part, based on the number of zero-emission vehicles or plug-in hybrid electric vehicles in their rental car fleet.

SEC. 3.

 Section 25724.4 is added to the Public Resources Code, to read:

25724.4.
 (a) The installation of electric vehicle supply equipment or supporting electrical and hydrogen fueling infrastructure by state entities to support state fleet operations pursuant to subdivision (d) of Section 599.808 of Title 2 of the California Code of Regulations shall not be construed to be gifts of public funds in violation of Section 6 of Article XVI of the California Constitution.
(b) State entities shall not be required to recover electric vehicle supply equipment upon the separation of a state employee.
(c) For purposes of this section, “electric vehicle supply equipment (EVSE)” means the unit that controls the power supply to one or more vehicles during a charging session.
